مشکلات جنسی و نقش آن در انحلال عقد نکاح در مذاهب خمسه

در حقوق ایران، عیوب و امراض غیر جنسیتی موجب فسخ، منحصر به موارد خاصی می باشد و عیوب احصا شده، بالأخص جذام و برص و نابینایی از عیوب مشترک موجب فسخ، تلقی نمی شوند و در این موارد صرفا زوج حق فسخ دارد، که با مبانی فقه مذاهب ارعه، کاملا مغایر می باشد. اکثریت فقهای شیعه، اعم از فقهای متقدم و فقهای معاصر، قائل به این نظریه هستند که زوجین در فسخ نکاح ناشی از عیوب غیرجنسیتی، حق مساوی ندارند و در صورت ابتلا زوجه به برص و جذام و نابینایی، حق فسخ، مختص زوج می باشد. از نظر فقهای شافعیه و مالکیه و حنابله، برص و جذام و جنون از عیوب مشترک بین زن و مرد هستند و تفاوتی بین زوجین در حق فسخ نکاح ناشی از عیوب مذکور وجود ندارد. حکم این دو عیب از نظر شافعیه و حنابله، مانند حکم جنون است. مطابق نظر مذهب حنفی، عیوبی نظیر جذام و برص برای هیچ یک از زوجین حق فسخ ایجاد نمی کند، اعم از اینکه در عقد شرط شده باشد و یا شرط نشده باشد؛ مگر در سه مورد عیوب جنسیتی مختص مردان که برای زوجه، حق فسخ ایجاد می شود. به غیر از این موارد، فسخ نکاح مترتب نمی شود به موجب اصل ? قانون اساسی، کلیه قوانین عادی جمهوری اسلامی، باید منطبق با موازین شرعی باشد. با عنایت به اختلاف نظر فقهای امامیه در خصوص تساوی و یا نابرابری زوجین در حق فسخ ناشی از عیوب غیر جنستی، به نظر می رسد که به منظور رعایت عدالت و تعادل حقوقی زوجین، امکان تغییر قانون مدنی، براساس فتاوای معتبر اقلیت فقهای شیعه، وجود دارد. بر طبق ماده ??? قانون احوال شخصیه کویت، هر یک از زوجین می توانند در صورت مشاهده عیب اساسی از جمله عیوب کراهت آور یا زیان بار با عیوبی که مانع از لذت یا تمتع شوند، ازدواج را فسخ نمایند.
