بررسی احکام فقهی حقوقی بانک شیر مادر

امروزه با توجه به اینکه در نظام سلامت تغذیه با شیر مادر از جایگاه ویژه ای برخوردار است، ضرورت دارد برای کودکانی که از این نعمت محروم هستند فکری اندیشیده شود. بسیاری از کشورهای جهان برای پر کردن این خلاء روی به تأسیس بانک شیر مادر آورده اند. در کشور ما ایران نیز احداث اینگونه بانک شیر در دست اقدام قرار گرفته است، امّا با چالش هایی نیز روبرو شده است مانند مسائل فقهی و حقوقی (رضاع و محرمیت) در بین کودکان استفاده کننده از این شیر؛ بر همین اساس هدف از پژوهش حاضر، ضمن روشن سازی اهمیت و مزایای شیر مادر در مقایسه با شیرهای مصنوعی و جایگزین، پاسخ به این سوال بنیادین است که آیا بانک شیر مبتنی بر آموزه های فقه شیعه و نظام حقوقی ایران هست یا خیر ؟ با این اوصاف آیا از نظر فقهی و حقوقی راه اندازی بانک شیر جایز شمرده شده است یا خیر؟ با توجه به مطالعات و بررسی های که پیرامون احکام فقهی و حقوقی بانک شیر مادر در این پژوهش صورت گرفت؛ قوانین موضوعه ی کشور جمهوری اسلامی ایران، از جمله قوانین مربوط به اسباب محرمیت که از فقه امامیه برگرفته شده است، فقهای شیعه به اتفاق آراء مکیده شدن مستقیم شیر از پستان را در ایجاد محرمیت رضاعی بین کودک شیرخوار و زن شیرده و خانواده ی او شرط می دانند، از شواهد و قراین چنین بر می آید که تاسیس بانک شیر مادر، به طور کامل و البته پس از تطبیق با شرع، مورد تایید و حمایت دین مبین اسلام می باشد. بررسی و مطالعه احکام فقهی و حقوقی بانک شیر مادر در این پژوهش در نهایت به این نتیجه رسید که با توجه به قاعده لا ضرر و قاعده رضاع و قوانین حقوقی و فقهی آن ، ایجاد بانک شیر مادر نه تنها موجب رضاع و محرمیت نمی گردد بلکه وجود اینگونه از بانک ها ضروری است و جایگاه ویژه ای دارد؛ اما باید در قوانین حقوقی و فقهی برای احداث و چگونگی تجمیع شیر و ارائه آن به کودکان لحاظ های قانونی و شرعی را پیش بینی نمود .

Exploring Human Milk Bank on Legal-Jurisdictional Grounds

Due to the significance of feeding infants with breast milk in the health system, it is necessary to think of a solution for the infants deprived of their mother’s milk. Many countries have solved this issue with establishing human milk banks. Though in Iran milk banks are being established, Islamic jurisprudential (foster and Mahram) and legal challenges are raised for the infants using these banks. Alongside clarifying the advantages and importance of using breast milk in comparison to infant formulas, the purpose of the current study is to find an answer to the fundamental question of whether milk banks are in accordance with Shi’a jurisprudence and Iran’s legal system or not. And whether constructing such banks are approved by jurisprudential and legal laws or not. In the light of the conducted studies on Islamic jurisprudential and legal laws of milk banks, the positive laws of Islamic Republic of Iran, such as laws of Mahrams which are extracted from Ja’fari jurisprudence, the majority of Shi’a jurists (Faqih) state direct milk suckling from the breast as the condition of becoming milk-suckling Mahrams between the infant and nursing mother and her family. It is gathered from the evidence that constructing milk banks in conformity with Sharia laws is approved and supported by Islam. The studies of Islamic jurisprudential and legal laws of milk banks showed that according to the principle of “No Harm, No Harassment” and principle of fostering, the establishment of milk banks does not result in fostering and Mahrams, and that the they are necessary, but legal and religious perspectives in the establishment of these banks and also milk collecting and dispensing should be considered.
