the juridical study of legislation the first constitution by holy prophet

It is necessary for every society to have law; it means that the people’s behavior and their action should be based on the social rules in order to live in suitable conditions and benefit intellectual and material portions of life. Constitution is the highest legal document of a country and it is used as a guideline for regulating other laws. Constitution defines diplomatic principles, conformation, hierarchy, place and boundaries of diplomatic power of state in every country and guarantees the people’s rights. Islam as a civilized religion has many honors, one of them is law and discipline which is presented for humanity and show the salvation way through following religious laws. After Muslims’ emigration to Medina, the holy prophet collected an agreement in order to prevent the Jews’ sabotage and enemies’ stimulations. According to historians, this agreement was the firmest basis for advancement the holy customs of Islam. One of God commands is the holy prism which was stated by holy prophet and approved by the whole. It was a part of constitution and supplied the popular affairs of Islam believers. The prism was circulated 15 centuries ago and it has forty clauses, and nowadays it is useful to solve social, legal, economic, politic and cultural problems. This study examined some clauses of the constitution through historical and juridical resources.
