: Divorce is a right which is legislated vindication of the men. There are many traditions in this regard and in Article 1133 of the Civil Code Iran has insisted on. However, there are cases in Islam and the Iranian Civil Code expressly allows a judge at the request of the wife, the divorce decree. Given the state of our present society, particularly in the field of family relationships, marital duties argued that if a man of his burden, whether woman can not divorce? This thesis is trying to use the verses and traditions and rules, to answer the questions above.
