The role of clerics and religious advisers in preventing divorce

The management of family relations and claims in this area is always considered by national legislators. In Iran, by adopting numerous laws related to family law, ultimately, the legislatures after the ups and downs, adopted the Law on Family Protection in 2012. The existence of theoretical challenges prior to the adoption of the law among the family lawyers will necessitate critique and review of the law and explain the strengths and weaknesses of the law and, if possible, make suggestions in the legislative field. In respect of crimes against the family, in addition to material (868-873), the Islamic Penal Code Chapter 19 of the Family Protection Law Articles 868 to 873 deals with the criminal law of the family. In this study, the review and analysis of these regulations leads to legal vacuum in this regard and the necessity of the criminalization of some acts such as the number of wives, child abuse, spousal abuse, which can be remedied by filling the existing vacuums of the law It completes the material in such a way as to bring about the interests of the family.
