بررسی تطبیقی حقوق کودک در کنوانسیون حقوق کودک با حقوق ایران

تلاش های جهانی در راستای حمایت از کودک به عنوان آسیب پذیر ترین عضو خانواده منجر به تصویب کنوانسیون حقوق کودک در سال 1989 توسط سازمان ملل متحد شد،که یکی از مهمترین و جامع ترین اسنادی است که در زمینه حمایت از حقوق کودکان سراسر جهان،تدوین شده است و تاکنون 191 کشور جهان از جمله ایران با اعلام حق شرط به آن پیوست. این کنوانسیون در جهت تأمین منافع کودکان و حمایت از آنان به عنوان اعضاء جامعه بشری تدوین شده است. با توجه به الحاق ایران به این کنوانسیون گام مهمی در جهت احقاق حقوق کودکان برداشته است. در این رساله سعی شده است ضمن بررسی دقیق معتبرترین و کامل ترین معاهده با موضوع حقوق کودک یعنی کنوانسیون حقوق کودک، به ارزیابی تأٌثیر این کنوانسیون در کشور ایران پرداخته شود تا ضمن شناخت نقاط ضعف و قوتی که در اجرای حقوق مربوط به کودکان وجود دارد، در نهایت به فکر ارائه¬ی راهی در جهت هماهنگی بیشتر قوانین و رویه‌های قضایی کشورمان در راستای حمایت از کودکان با کنوانسیون حقوق کودک باشیم.. روش تحقیق در این پژوهش تطبیقی است و هدف از آن مقایسه¬ی مفاد کنوانسیون 1989 با قوانین و رویه های موجود در ایران می‌باشد. هرچند حقوق ایران به پیروی از فقه در رابطه با حقوق مالی کودک از جمله وصایت، وراثت و حقوق معنوی وی از جمله تعیین نام نیکو، نسبت به کنوانسیون حقوق کودک کامل¬تر می¬باشد، لیکن، در مقایسه¬ی تطبیقی بین قوانین مربوط به حقوق کودکان در کنوانسیون حقوق کودک و ایران پی می¬بریم که شکاف های قابل توجهی در مسیر اجرای حقوق کودکان وجود دارد از جمله سکوت قانونگذار ایرانی در رابطه با کودکان پناهنده و کودکان بازمانده از جنگ که این مسأله نیازمند تمرکز بیشتر سیاست های عمومی بر روی تمام کودکان و به کارگیری کنوانسیون به عنوان یک مبنا و چهارچوب می¬باشد. با وجود اینکه کنواسیون از نقاط قوت و محاسن برخوردار است،.ولی به نوبه ی خود دارای ایراداتی بر آن وارد است و اکثر کشور ها پس از تصویب کنواسیون ،در کشور خود به تدریج قوانین و مقررات خود را اصلاح کرده یا تغییر داده اند.تحقیق حاضر از 2 فصل می باشد که در فصل اول به تعریف و مفهوم کودک و در فصل دوم به طور کلی به بررسی حقوق کودک در ایران و کنوانسیون حقوق کودک پرداخته شده است.

A comparative study of children's rights in the CRC to the Iranian law

Worldwide efforts to protect the child as the most vulnerable family member led to the United Nations Convention on the Rights of the Child in 1989, which is one of the most comprehensive and comprehensive documents on the protection of the rights of children throughout the world. So far, 191 countries, including Iran, have joined it with a right to claim. The Convention has been drafted to protect the interests of children and support them as members of the community. Considering the accession of Iran to this Convention, an important step has been taken to secure the rights of children. This thesis attempts to assess the impact of this convention in Iran, while carefully reviewing the most authoritative and most comprehensive treaty on the rights of the child, the Convention on the Rights of the Child, in order to identify the weaknesses in the implementation of children's rights. Finally, we are thinking of providing a way to further harmonize the laws and procedures of our country to protect children with the Convention on the Rights of the Child. The research method in this comparative study is to compare the provisions of the 1989 Convention with the existing laws and practices in Iran. However, Iran's rights to follow jurisprudence regarding the child's financial rights, including her right to inheritance and her intellectual rights, including naming her name, are more complete than the Convention on the Rights of the Child, but in comparative comparisons between the relevant laws We recognize the rights of children in the Convention on the Rights of the Child and Iran that there are significant gaps in the way children's rights are exercised, including the silence of the Iranian legislature on refugee children and survivors of childhood, which requires a greater focus on public policy For all children and the application of the Convention as a basis and framework
