نقش قاعده تحذیر در مسئولیت والدین در قبال فرزندان

والدین در برابر فرزندان تکالیفی بر عهده دارند که بخشی از آن ها در قانون مشخص شده است و مواردی هم از عرف استنباط می شود. بنابراین، قانون بر روابط آنان حاکم است و تکالیفِ مقرر منشأ قراردادی ندارند. ا زای نرو، طبیعی است که انجام ندادن تکالیف، باعث نقضِ حقوق فرزندان می گردد و بالتبع، مسئولیت مدنی والدین را - در صورت وجود دیگر شرایط- در پی دارد؛ زیرا والدین نیز مانند سایر افراد حق تعرض به حقوق فرزندان و آسیب رساندن به آ نها را ندارند و طبق قاعده، تمامی خسارات باید جبران شوند و هیچ ضرر غیرمتدارک نباید وجود داشته باشد. در کنار مسئولیت مدنی شخصی و یا آغازین که برای یک شخص و سبب زیانی که به دیگری وارد کرده است تحقق می یابد، گونه دیگری از مسئولیت مدنی پا به عرصه وجود گذاشته است که برپایه آن شخص می بایست زیانی را که به وسیله شخص دیگر به شخص سومی وارد گردیده است جبران کند یعنی با وجود اینکه شخصاً چه در قالب مباشرت و چه در قالب تسبیب نقشی در ورود زیان توسط شخص دیگر به شخص سومی نداشته است با این وجود و به سبب اراده قانونگذار و یا قرارداد بین شخص زیانکار و شخص دیگر مسئولیت جبران زیان وارده را برعهده دارد قاعده ی تحذیر یا همان قاعده ی هشدار می تواند در صورتی اثبات شود که به مخاطب در مورد امری خطرناک قبل از انجام آن هشدار داده باشد موجب رفع مسئولیت از طرف شده باشد که در مورد والدین هم درصورتی که در باره خطرات بازی ، یا ازدواج و یا عدم تحصیلات به فرزند هشدار داده باشد از والدین رفع مسئولیت شود.
