The Role of Social Justice in Jurisprudence and Law with an Approach to the Views of Imam Khomeini and the Supreme Leader

The role of justice in jurisprudence and explaining its place in the two major sources of Shiite jurisprudence, namely the book and tradition. From the jurisprudential point of view, the justice of a person can be proved by the approval of two just people or a lot of association with him or the religious belief in his justice. Another aspect of justice that the constitutional legislature has entrusted to the judiciary is the realization of judicial justice. It is in conflict with other social justice. In the political school of Imam Khomeini, social justice has a very high status and importance. In this school, the realization of social justice has been the goal of the resurrection of the prophets and the Islamic Revolution and the struggle against the tyrannical regime, as well as the secret of the enemy of arrogance, and ignoring it will have dire consequences for the government and the wealthy. According to this school, in the government and society, all sections of society should have equal rights and all should be equal before justice. Also, the Imam pays attention to the merits of individuals. In the government, the law and legal norms should govern it, the officials should not seek to gain special privileges for themselves, and they should always seek to fill the class gaps in favor of the deprived by knowing that they are serving the people. The entry of the Supreme Leader of the Revolution into the issue of justice has been from the perspective of a privileged religious position and role. In this study, the role of social justice in jurisprudence and law has been tried to study the views of Imam Khomeini and the Supreme Leader in a descriptive and explanatory manner.
