پیامدهای الحاق ایران به موافقت نانه جنبه های تجاری مالکیت فکری

لازمه ورود ایران به سازمان تجارت جهانی پیوستن به موافقتنامه جنبه های تجاری مالکیت فکری است موافقتنامه ای که در چهارچوب سازمان تجارت جهانی شکل گرفته است و به حقوق مالکیت فکری مرتبط با تجارت پرداخته و پذیرش آن برای کشورهای عضو این سازمان الزامی است و ایران به عنوان عضو ناظر در مقام کسب آمادگی برای الحاق به این سازمان بوده و باید مقررات حوزه مالکیت فکری خود را با الزامات تریپس همسو سازد. در این پژوهش مقررات ایران در حوزه مالکیت ادبی و هنری و صنعتی با موافقتنامه جنبه های تجاری مالکیت فکری مقایسه شده است و پیامدهای الحاق آن نیز بیان شده است. گرچه قوانین موجود در کشور، در بسیاری از موارد با مقررات بین المللی مطابقت داشته و یا حداقل مغایرتی ندارد ولی در برخی موارد مجمل و ناکافی هستند و در برخی موارد نیز خلاء قانونی وجود دارد و با توجه به اینکه یکی از شرط های پیوستن به سازمان جهانی تجارت، وضع قوانین مناسب برای حمایت از مالکیت فکری می باشد لذا ضروری است که قوانین و مقررات ایران در زمینه حقوق مالکیت فکری و معنوی تجدید نظر و بازنگری شود. از حوزه های مهمی که اکنون در هیچ یک از قوانین ایران به چشم نمی خورد و با پیوستن به موافقت نامه بطور کامل به آن پرداخته شده است، قراردادهای لیسانس می باشد. تصویب قوانین در این راستا و هماهنگ بودن از الزامات کشور محسوب می شود. اما با پیوستن به این کنوانسیون ها بی شک معضلات و مشکلاتی را نیز برای مخاطبین آن قرار خواهد داد. می توان با تصویب و اجرای قوانین کارآمد این خلاءها را مرتفع نمود، در حوزه مالکیت صنعتی با وجود کاستی ها حداقل استانداردهای لازم و برابر با موافقتنامه جنبه های تجاری مالکیت فکری وجود دارد. در نهایت امر اینکه پیوستن ایران به تریپس لازم و ضروری بوده و باعث حمایت از سرمایه و فکر ایرانی و پیشرفت کشور خواهد شد اگرچه محدودیت هایی نیز دارد.

Iran's accession to WTO requires accession to the Agreement on Trade-Related Aspects of Intellectual Property An agreement established within the World Trade Organization dealing with trade-related intellectual property rights and its acceptance is mandatory for its member states and Iran as The supervisory member is in readiness to join the organization and must comply with its IPR requirements with TRIPS requirements. In this study, Iranian regulations in the field of literary, artistic and industrial property have been compared with the Agreement on Commercial Aspects of Intellectual Property and the implications of its incorporation have been stated. Although the laws in the country, in many cases are in conformity with international law or at least inconsistent, in some cases they are inadequate and in some cases there is a legal vacuum and as one of the conditions for joining the organization. The World Trade is the creation of appropriate laws to protect intellectual property. Therefore, it is imperative that Iranian laws and regulations on intellectual and intellectual property rights be reviewed and revised. One of the important areas that is not currently covered by any of Iran's laws and has been fully addressed by joining the agreement is bachelor contracts. Adoption of laws in this regard is one of the requirements of the country. But adhering to these conventions will undoubtedly present problems to its audience. By enacting and enforcing effective laws, these gaps can be remedied. In the field of industrial property, there are at least some standards that are equal to the Agreement on Trade-Related Intellectual Property. Finally, joining TRIPS will be necessary and will support Iranian capital and thought and development of the country, albeit with some limitations.
