مطالعه تطبیقی اثار انحلال نامزدی در حقوق مدنی ایران و کامن لا
نامزدی یک تعهد قراردادی قابل فسخ به شمار میآید و برابر صراحت قانون هر یک از طرفین تا زمان انعقاد قرارداد میتوانند آنرا فسخ نمایند و به نوعی الزام در این قرارداد قابل مشاهده نمیباشد و حتی از آنجایی که توافقی برخلاف قاعده آمره صورت گیرد چنین توافقی باطل میباشد و مخالف نظم عمومی تلقی میگردد.
وعده نکاح ایجاد علقه زوجیت نمیکند بنابراین از نظر قانونی هر شخص میتواند از نامزد دیگری خواستگاری نماید هر چند که از نظر فقهی و شرعی خواستگاری از نامزد دیگر حرام میباشد ولی در صورت انعقاد عقد حکم بر صحیح بودن عقد حکم بر صحیح بودن عقد صادر گردیده است. در نامزدی در خصوص برهم زدن قابل مطالبه در حقوق ایران با توجه به حذف ماده 1036 قانون مدنی امکان پذیر نمیباشد ولی در حقوق کامن لا با تئوری قاعده غرور و سوء استفاده از حق میتوان خسارت ناشی از بر هم خوردن نامزدی را مطالبه نمود.
در حقوق ایران و کامن لا با به هم خوردن نکاح امکان استرداد هدایا امکان پذیر میباشد. مبنای استرداد هدایا نامزدی در حقوق ایران هدایای مشروط میباشد. معرفی این تئوری از سوی حقوقدانان ایران به جهت عدم کارایی تئوری انتفای سبب عقد میباشد اما در حقوق کامن لا علاوه بر تئوری هدایای مشروط، تئوری فریب و تئوری دارا شدن ناعادلانه نیز به عنوان مبنای استرداد هدایای نامزدی مورد استناد واقع میشود.
