Title : Review of the Peace Court's competence in handling family disputes

The overlap of jurisdiction between the family court and the peace courts in lawsuits is one of the important issues of the Iranian judicial system, which can increase costs and increase contradictions in the execution of judgments. The main purpose of this research is to explain and analyze the limits of the jurisdiction of the peace court in resolving family lawsuits with the new Dispute Resolution Council law and its effects on the family litigation system in Iran. Given that in many financial lawsuits, there are family ties between the parties, determining jurisdiction solely based on the amount of the lawsuit causes problems in identifying the month of the cases and issuing repeated incompetence orders. This research was conducted using a descriptive-analytical method and by examining existing laws, including the Family Protection Law and the Civil Procedure Code The findings of the study show that the overlapping of jurisdictions not only prolongs the litigation process, but can also lead to the issuance of contradictory orders regarding the joint property of the spouses, which endangers the legal security of the litigants. The overlapping of jurisdictions between the family court and the justice of the peace can lead to contradictions in the issuance of protective and enforcement orders. When a financial dispute has family dimensions, the lack of coordination between these two authorities causes the necessary protective measures for the parties (especially women and children) in the family court to conflict with the financial measures in the justice of the peace court. This contradiction not only violates the principle of unity of the dispute, but also affects the efficiency of the judiciary. Finally, this study suggests that to address this problem, the criterion for determining jurisdiction should be changed from the amount of the claim to the nature of the claim, so that every financial case with family dimensions falls under the jurisdiction of the family court. Also, strengthening coordination between these two courts through the development of new guidelines and the use of emerging technologies in judicial systems to automatically identify cases of jurisdictional overlap are among the main solutions to resolve this problem and promote justice in family litigation.
