Examining the potential of Shiite jurisprudence in preventing children and adolescents from reoffending based on the ۲۰۲۰ Children and Adolescents Protection Law

This thesis conducts a comparative analysis of the capacities of Shia jurisprudence and the Law on the Protection of Children and Adolescents, enacted in 1399 (2020), in preventing recidivism among this demographic. Given the rising incidence of crimes committed by children and adolescents and the critical importance of preventing the recurrence of these offenses, this research aims to identify the points of convergence and divergence between relevant legal provisions and jurisprudential rulings. In this context, key jurisprudential concepts such as education, ta’zir (discretionary punishment), hudud (fixed punishments), and qisas (retribution) will be examined, along with institutions like guardians, caretakers, and rehabilitation centers. Additionally, contemporary preventive approaches in Shia jurisprudence will be analyzed, focusing on the roles of family, school, and community in the education and prevention of juvenile delinquency. This study will demonstrate how leveraging local capacities and existing governmental institutions, along with family education and the utilization of modern technologies, can effectively safeguard children and adolescents from criminal behavior. .
