Guaranteeing the implementation of unfair conditions with an emphasis on economic rights

It is one of the emerging and almost new schools in the field of economic law, which has more up-to-date and logical concepts with today's human needs. In traditional private law, especially in Iranian law, the rule of will is emphasized, and in the economic analysis of rights, the interests of the parties from contracts and transactions are considered. According to this point of view, tolerance of loss has reached the lowest possible level and relationships are defined in a way that includes the rights of both parties to contracts and transactions. Based on this, unfair terms may be included in the contracts, and entering into the adjustment or cancellation of such terms can minimize the burden of loss on the shoulders of the obligee. However, like medical surgery, it is a matter of precision and risk, lest it weaken the sovereignty of the will and the principle of the necessity of contracts.
