بررسی نظام مسئولیت کیفری حاکم بر جرایم اطفال و نوجوانان در قانون مجازات اسلامی

بزهکاری اطفال و نوجوانان از جمله مسائل مبتلا به دنیای امروز است و به منظور جلوگیری از بزهکاری اطفال و نوجوانان، نقش قوانین مطلوب و مناسب خصوصاً قوانین مربوط به دادرسی اطفال انکارناپذیر است. بعد از پیروزی انقلاب اسلامی و تغییرات مختلف در نظام قضایی کشور، مقررات دادرسی اطفال نیز دچار تحول و دگرگونی شد و ازجمله این تحولات نسخ ضمنی قانون تشکیل دادگاه اطفال بزهکار مصوب 1338 و تغییر سن مسئولیت کیفری می‌باشد. پس از نسخ قانون مذکور ضرورت وجود دادگاه اطفال با دادرسی ویژه، عملاً در محاکم احساس گردید. بعد از تصویب قانون تشکیل دادگاههای عمومی و انقلاب وتغییر سیستم قضایی در سال 1373 چشم‌های جامعه حقوقدانان کشور به تصویب قانون آیین دادرسی مربوطه دوخته شد تا اینکه در سال 1378 قانون آیین دادرسی دادگاههای عمومی و انقلاب درامور کیفری به تصویب رسید. مواد 219 تا 231 این قانون مربوط به چگونگی دادرسی اطفال و نوجوانان بود که عملاً نتوانست پاسخگوی انتظارات جامعه و همچنین رفع مشکلات و معضلات دستگاه قضایی باشد. در خصوص تشکیل دادگاههای اطفال بزهکار نیز پیش نویس لایحه قانونی تشکیل دادگاه اطفال و نوجوانان در سال 1382 با محوریت دستگاه قضایی و نظرخواهی از اساتید دانشگاه وقضات دادگستری و همچنین کسب نظر از یونیسف تهیه و تدوین گردیده وبه مجلس شورای اسلامی تقدیم شده که این لایحه در مقایسه با قوانین سابق کاملتر و تا حدودی با کنوانسیون حقوق کودک مطابقت دارد. مطالعات جرم‌شناسی نشان می‌دهد غالب اطفال بزهکار در محیط‌های نامساعد اجتماعی و خانوادگی رشد می‌یابند و علاوه بر آنکه در چنین محیط‌هایی از آموزش و فراگیری شیوه‌های جامعه پذیری محروم می‌باشند، متأثر از خرده فرهنگ‌های بزهکاری بوده و قواعد و اصول زندگی بزهکارانه را می‌آموزند. از این رو دیدگاههای نوین جرم‌شناختی خواهان مداخله در فرایند رشد و جامعه پذیری اطفال می‌باشند.

Investigation of criminal liability of the juvenile crime in the Penal Code

Abstract: The delinquency of children and adolescents is one of the issues facing today's world. In order to prevent juvenile delinquency, the role of appropriate and appropriate laws, especially those relating to child justice, is indisputable. After the victory of the Islamic Revolution and various changes in the country's judicial system, the provisions of the judiciary have also undergone a change, including the implied copies of the Law on the Establishment of the Delinquent Children's Court in 1338 and the change in the age of criminal responsibility. Following the edition of the law, the necessity of the existence of a court of special tribunal was practically before the courts. After the enactment of the Law on the Establishment of Public and Revolutionary Courts and the Revision of the Judicial System in 1373, the eyes of the lawyers community of the country were enacted by the relevant tribunal law, until the Public Prosecution and Revolutionary Courts of Public Prosecutor's Code of Criminal Procedure was enacted in 1999. Articles 219 to 231 of this law were about how the children and adolescents were handled, which virtually failed to meet the expectations of the community, as well as to resolve the problems and problems of the judiciary. On the formation of criminal courts for criminal offenses, a draft law on the formation of a court of children and adolescents was drafted in 2003, centered on the judiciary and a survey of university professors and judiciary officials, as well as an opinion from UNICEF. The bill was presented to the Islamic Consultative Assembly. Comparing with the former is more complete and partly compatible with the Convention on the Rights of the Child.Criminological studies show that predominantly delinquent children develop in disadvantaged social and familial settings, and in addition to being excluded from education and learning of socializing practices, they are affected by subcultures of delinquency and learn the rules and principles of criminal life. Hence, new criminological perspectives call for intervention in the process of development and socialization of children..
