مبانی حقوقی در منع انحصار و تسهیل رقابت تجاری حقوق ایران و اتحادیه اروپا

از آنجایی که با پیروزی نظام جمهوری اسلامی ایران موجب کاهش نقش دولت در تصدی گری امور تجاری و رقابتی و واگذاری آن به بخش خصوصی منع تسهیل رقابت تجاری نقش پررنگ تری پیدا می کند زیرا هر دولتی سعی در اعمال قوانین و مقررات سرزمینی خود نسبت به طرف مقابل دارد. از انجایی که موازین و مقررات ایران در اوصل تجاری و رقابت های تجاری بر اساس معیارهای اسلامی می باشد بنابراین مجبور به رعایت موازین اسلامی می باشند. قاعده لاضرر یکی از اصول مهم در رقابت های تجاری طبق اصول اسلامی در قوانین ایران می باشد که معیاری مهم در امر تسهیل رقابت های تجاری می باشد. اما در مواردی که دولت با طرف دیگر که کشوری خارجی می باشد وارد رقابت شده و بر اساس قاعده لاضرر باید نفع و زیان خود را مد نظر داشته باشد اما اگر با منافع اساسی و حیاتی خود منافی بود می تواند حکم به نفی ضرر دهد هر چند شورای رقابت اختیار چنین امری را ندارد. در این صورت به دلیل انجام امور تجاری با سایر کشورها می توان اقدام به تدوین قوانینی در خصوص تسهیل رقابت تجاری و ممانعت از انحصار نمود تا تبادلات تجاری بهتر صورت پذیرد. این امر در اتحادیه اروپا نیز به خوبی مشهود می باشد. طبق قوانین اتحادیه منع تسهیل رقابت تجاری در شمار تهدیدات مظمون هستند اما در حقوق ایران این امر در هاله ای از ابهام قرار دارد.
