بررسی و تحلیل فقهی و حقوقی جرم قاچاق انسان
قاچاق انسان پدیده ی خطرناکی است که در قرن بیست و یکم تمامی جامعه ی جهانی ، از جمله ایران را تهدید می کند. خرید و فروش انسان و سوء استفاده از افراد بشری از دیر باز وجود داشته ؛ لیکن ویژگی های اصلی این عمل مجرمانه که آن را خطرناک می کند؛«سازمان یافته » و «فراملی» شدن آن است. قاچاق انسان به سه منظور اصلی صورت می گیرد که می توان آن را به شرح ذیل تقسیم بندی کرد: الف) قاچاق زنان و کودکان ؛ که هدف آن سوء استفاده های جنسی است . ب) قاچاق مهاجران ؛ که به صورت گذر نامه ی جعلی افراد را به صورت غیر قانونی از مرزهای کشورها عبور می دهند. ج) قاچاق اعضا و جوارح انسان ؛ که با هدف فروش اعضای بدن از جمله کلیه ، کبد ، قلب ؛ صورت می گیرد.
قاچاق انسان معضلی است که هیچ کشوری نمی تواند ادعا کند که کاملا از آثار شوم آن مصون است .تاکنون تحقیقی میدانی در خصوص شیوه ها و میزان قاچاق زنان و کودکان در ایران صورت نگرفته است. باتکیه به مستندات فقهی و استفاده از آیات و روایات و نظرات فقها و مفسران نتیجه می شود جرم قاچاق انسان از مصادیق بارز افساد فی الارض و فتنه گری می باشد و باید مجازات مفسدین فی الارض برای مرتکبان که به صورت باندی و تحت شبکه های بین المللی به این امر اقدام می ورزند در نظر گرفت .

Human trafficking is a dangerous phenomenon that in the 21st century threatens the entire international community, including Iran. Due to the jurisprudential documentation and the use of verses, narrations, and comments from jurisprudents and commentators, the crime of human trafficking is one of the most obvious examples of corruption in infamy and seduction, and the punishment of corruptors on earth for perpetrators who are both gangs and international networks Take this into consideration
