عدالت در میانجیگیری برای جرایم اقتصادی

در یک جامعه مطلوب انسانی، برای حل تعارضات و اختلافات و نیز پاسخ‌دهی به نقض هنجارها، استفاده ابزارهای غیر قضایی از جمله اخلاق و عرف با کرامت انسانی سازگارتر بوده و توسل به آن‌ها از اولویت برخوردار است. میانجی‌گری بین طرفین دعوی (در دعاوی حقوقی و دعاوی کیفری واجد جنبه حق الناسی) و میانجی‌گری بین قاضی و مجرم یا شفاعت (در امور کیفری حق اللهی) دو راه حل غیر قضائی برای حل و فصل دعاوی هستند. عدالت ترمیمی به دنبال پیشگیری از تکرار جرم و بزه دیدگی افراد، کشف و فهم ریشه های جرم و حل اختلاف طرفین و جلب مشارکت جامعه محلی در حل و فصل دعاوی با تاکید بر ارزش های فرهنگی است. در این دیدگاه بزهکار به نقض قانون و مخالفت با نظم برپا شده توسط دولت به تحمل کیفر محکوم نمی شود بلکه با به کارگیری روش های گفتگو بین مجموعه ای از افراد که در وقوع جرم سهم و نقشی داشته اند با میانجیگری، مذاکره، صلح و سازش، اسباب رفع اختلافات طرفین درگیری فراهم می شود. بدین ترتیب با ایجاد آشتی میان آنان، روابط آسیب دیده ترمیم و در پیوندهای اجتماعی شکسته شده مجدداً اتصال و ارتباط برقرار می شود. بنابراین اجرای الگوی عدالت ترمیمی تاحدود زیادی مبتنی بر مشارکت بزهکار و بزه دیده و اعضای جامعه محلی است که بدون همکاری هر یک از اضلاع مثلث مذکور اهداف عدالت ترمیمی محقق نخواهد شد. لایحه آیین دادرسی کیفری در ماده 82 موضوع «میانجیگری» را در جرایم تعزیری درجه 8، 7، 6 (مانند اختلاس و ربا و...) رامطرح کرده، این جرایم غالبا قابل گذشت و یا جرایمی هستند که گذشت شاکی یا مدعی خصوصی در تخفیف موثر است. این امر موجب کاهش تراکم پرونده ها و کاهش هزینه های بزه دیده و در مورد متهم باعث فراهم شدن زمینه برای تسریع باز اجتماعی شده او می شود.

Justice in mediation for economic crimes

In a desirable human society, the use of non-judicial tools such as ethics and custom is more compatible with human dignity and priority is given to resolving conflicts and disputes and responding to norms. Mediation between litigants (in legal and criminal cases) and mediation between the judge and the offender or intercessor (in criminal law matters) are two non-judicial solutions to litigation. Restorative justice seeks to prevent the repetition of crime, to discover the root causes of crime and to resolve disputes, and to engage the local community in resolving disputes with an emphasis on cultural values. In this view, the offender is not condemned to tolerate punishment for violating law and order established by the government, but rather for engaging in dialogue between a group of individuals who have played a role in the commission of the crime, through mediation, negotiation, peace and reconciliation. The conflict resolution tools are provided. Thus, by reconciling them, damaged relationships are restored and reconnected in broken social bonds. Therefore, the implementation of the Restorative Justice model is largely based on the involvement of delinquents and members of the local community who will not achieve the goals of Restorative Justice without the cooperation of each side of the said triangle. The Code of Criminal Procedure in Article 82 addresses the issue of "mediation" in Tabriz Offenses of Grade 8, 7, 6 (such as embezzlement and usury, etc.), these offenses are often forgivable, or offenses that involve the indictment or private prosecution. The discount is effective. This reduces the congestion of the case and reduces the cost of the crime, and provides the grounds for the accused to open up for his social openness.
